Involved In A Miscarriage Of Justice : Court of Criminal Appeal certified a miscarriage of justice.Their lawyers will now lodge a claim for compensation with the Minister for Justice, Equality and Law Reform.

In 1995 the court had quashed the convictions of Joseph Meleady and Joseph Grogan who had been jailed for five years in 1985 for assaulting Eamon Gavin and causing damage to his car at Cremore, Templeogue, Dublin, on February 24, 1984.

Mr Justice Geoghegan, sitting with Mr Justice Kearns and Mr Justice Murphy, said yesterday that the case, which arose from the theft of Mr Gavin's car in 1984, had a quite extraordinary history. Mr Gavin had jumped on the bonnet and was carried at speed for a time before getting off after being threatened with a petrol can and hit with an umbrella.

While the court had nothing but sympathy for Mr Gavin who had had a horrific experience, it hoped he would appreciate the court was deciding, under the Criminal Procedure Act 1993 (CPA), whether newly discovered facts were tantamount to proving a miscarriage of justice.
